Electronic W-2 Furnishing: The 31.6051-1(j) Consent Mechanics, the Website Posting Notice, and the October 15 Access Clock

Electronic delivery of Form W-2 is permitted when the recipient affirmatively consents, receives the required disclosures, and can access the statement in its furnished format. Website delivery adds a specific posting notice, an undeliverable-email fallback, and a required access period. Under 26 CFR § 31.6051-1(j), website-posted Forms W-2 generally must remain available through October 15 of the year after the statement year. The ordinary furnishing deadline in paragraph (d) is on or before January 31.
Requirements table
| Requirement area | Rule and operational effect | Controlling authority |
|---|---|---|
| Applicability | A person required to furnish Form W-2 may provide it electronically instead of on paper. Electronic furnishing is treated as timely when the applicable requirements in paragraphs (j)(2) through (6) are met. | 26 CFR § 31.6051-1(j)(1) |
| Consent and timing | The recipient must affirmatively consent. Electronic consent must reasonably demonstrate the recipient can access the W-2 in the format used. Paper consent is permitted if confirmed electronically. Required disclosures must be provided before or when consent is given. | § 31.6051-1(j)(2)–(3) |
| Delivery method | For a website posting, notify the recipient by mail, email, or in person. Explain how to access and print the statement. Include "IMPORTANT TAX RETURN DOCUMENT AVAILABLE" in capital letters. For email, use that exact phrase in the subject line. | § 31.6051-1(j)(5)(i) |
| Exceptions and fallback | If a website-posting email is returned undeliverable and the correct address cannot be obtained from the furnisher's records or the recipient, send the notice by mail or provide it in person within 30 days after the email is returned. | § 31.6051-1(j)(5)(ii) |
| Access period | Keep website-posted W-2s available through October 15 of the year following the statement year, subject to the first-business-day adjustment if October 15 falls on a weekend or legal holiday. Corrected forms must remain available through that date or 90 days after posting, whichever is later. | § 31.6051-1(j)(6) |
| Paper statements and deadline | If consent is withdrawn before electronic furnishing, provide a paper statement. A paper statement furnished after the due date is considered timely if furnished within 30 days after withdrawal is received. The ordinary furnishing deadline is January 31, with a separate rule for certain terminated employees who request an earlier statement. | § 31.6051-1(j)(7), (d)(1)(i) |
Consent must demonstrate access
The regulation requires an affirmative choice, not merely an employee's ability to use a payroll portal. The consent method must reasonably demonstrate that the recipient can access the W-2 in the format that will be furnished.
Consent can be electronic. It can also be provided in a paper document if electronically confirmed. The record should connect the recipient's affirmative action to the format, system, and disclosure version presented at that time.
Before or when obtaining consent, provide a clear and conspicuous disclosure covering all required items:
- The W-2 will be furnished on paper if the recipient does not consent.
- The scope and duration of consent, including whether it applies to later W-2s until withdrawn or only to the next statement.
- How to request a paper copy after consent, and whether that request will count as withdrawal.
- How to withdraw consent in writing, electronically or on paper, with the required contact person or department's name, mailing address, telephone number, and email address.
- That the furnisher will confirm the withdrawal and its effective date in writing, and that withdrawal does not affect a statement furnished electronically before it takes effect.
- Conditions under which electronic furnishing will stop, such as termination of employment.
- How to update recipient contact information, and how the furnisher will communicate changes to its own contact information.
- Hardware and software needed to access, print, and retain the W-2; the date the W-2 will no longer be available on the website; and notice that printing may be necessary for a federal, State, or local income tax return.
A material change to hardware or software that creates a material risk the recipient will lose access requires advance notice of the revised requirements and the need for new consent or confirmation. After the change, obtain that consent or confirmation before relying on electronic furnishing in the revised format.

Website posting requires a separate notice
Posting a W-2 online is not, by itself, the required notice that the statement is available. The furnisher must notify the recipient that it has been posted and provide instructions for accessing and printing it.
Email notices have an exact subject-line requirement: IMPORTANT TAX RETURN DOCUMENT AVAILABLE. The phrase must appear in capital letters on the subject line. A message body containing the phrase does not meet that subject-line instruction if the notice is sent by email.
When the email is returned as undeliverable, check whether a correct electronic address can be obtained from the organization's records or from the recipient. If not, furnish the notice by mail or in person within 30 days after the returned email. The rule sets the method and timing for this fallback, but it does not specify a class of mail. Selecting and documenting a mailing method is an operational evidence decision, not a method prescribed by this paragraph.
For corrected Forms W-2 furnished electronically, furnish the corrected form electronically. If the corrected form is posted on a website, notify the recipient of the corrected posting within 30 days, using the notice method and required statement. Mail or in-person delivery is required for the corrected form or its notice when an electronic notice of the original or corrected posting was returned undeliverable and the recipient has not supplied a new email address.
Calculate the October 15 access period
A website-posted Form W-2 must remain available through October 15 of the year following the calendar year to which it relates. If that date falls on a Saturday, Sunday, or legal holiday, access must continue through the first business day afterward.
For example, a Form W-2 for calendar year 2025 was subject to the October 15, 2026 access date. For a 2026 Form W-2, the corresponding date is October 15, 2027. Corrected Forms W-2 have a separate calculation: access must continue through the applicable October 15 date or 90 days after the corrected form is posted, whichever is later.
The employee-facing disclosure must state when the W-2 will no longer be available on the website. Payroll operations should align that disclosed date with the access-period calendar and verify availability before removing or restricting the document.
Withdrawal requires a paper-statement workflow
A recipient may withdraw consent in writing, electronically or on paper, using the contact information provided in the disclosure. The furnisher must confirm the withdrawal and effective date in writing. The furnisher can make withdrawal effective on receipt or a later date, and can define a paper-statement request as a withdrawal.
If withdrawal takes effect before the W-2 is furnished electronically, provide a paper statement. If the paper statement is furnished after its due date, it is considered timely when furnished within 30 days after the withdrawal is received.
The general federal E-SIGN framework addresses electronic records and signatures, including consent rules for certain consumer disclosures. Section 31.6051-1(j) supplies the specific W-2 furnishing requirements. Its exact email subject line, website access period, and undeliverable-notice fallback are operational duties payroll teams should track directly rather than treating general electronic-consent controls as a substitute.
Practical implementation guidance
Keep the W-2 delivery workflow separate from the legal requirements table in system design, but connect each event in the evidence record. A payroll or HRIS process can assign owners and alerts for consent, disclosure versions, website notices, returned emails, corrections, access dates, and paper requests.

Use this evidence-file checklist for each annual cycle:
- Consent: recipient identity, timestamp, affirmative action, format presented, and evidence that the consent method demonstrated access.
- Disclosure: version provided, delivery or presentation date, and confirmation that all required items were included.
- Posting notice: recipient, posting date, notice channel, access and print instructions, and the exact email subject line when applicable.
- Undeliverable fallback: returned-email date, address review, evidence that a correct address was unavailable, fallback method, and completion date within the 30-day window.
- Corrected statement: correction posting date, notification date and method, new-address status, and corrected-form access end date.
- Access calendar: statement year, October 15 date or first-business-day adjustment, correction posting date, and the later applicable access end date.
- Withdrawal or paper request: date received, effective date, confirmation sent, paper-furnishing date, and calculation of any 30-day timeliness window.
- Format change: advance notice, description of revised requirements, new consent or confirmation, and implementation date.
A written mail or in-person fallback record should identify the recipient, notice, method, and date. The regulation does not name a required mailing class, so do not represent a particular class of mail as mandated by § 31.6051-1(j)(5)(ii).
Organizations can extend the same record discipline to broader notice retention controls and audit trail practices. National Compliance Registry's services describe support for controlled records, clear ownership, and documented notice workflows.
Deadline backdrop under paragraph (d)
The ordinary deadline for furnishing Form W-2 is on or before January 31 of the year after the calendar year covered by the statement. If employment ends before year-end, the employer may furnish the statement after termination, but no later than January 31.
A terminated employee can request an earlier statement when there is no reasonable expectation of further employment during the calendar year. In that case, furnish the statement by the later of 30 days after the request or 30 days after the last wage payment. These deadlines are separate from the website access period: furnishing on time does not end the obligation to maintain online access through the applicable October date.
